Representation in Labour Disputes

When disputes cannot be resolved internally and a claim is brought against your business, experienced legal representation is essential.

We assist employers by:

  • preparing and filing the necessary documentation,
  • engaging with the Department of Labour and other authorities,
  • liaising with opposing parties or trade unions, and
  • representing clients at CCMA, Bargaining Council, and Labour Court hearings.

Our approach is strategic and measured, aimed at resolving disputes efficiently while protecting your business interests.

For Employees and Employers

Labour Lawyers for Employees in Durban

We act for employees as well as employers. If you believe you have been treated unfairly at work, the time limits under the Labour Relations Act are short, so it is important to get advice early:

  • Unfair dismissal disputes must be referred to the CCMA, or the relevant bargaining council, within 30 days of the dismissal.
  • Unfair labour practice disputes, for example about promotion, demotion, suspension or benefits, must be referred within 90 days.
  • Unfair discrimination disputes must be referred within six months.

Our labour attorneys assist employees with unfair and constructive dismissals, retrenchments, disciplinary hearings, unpaid wages and leave, restraints of trade and discrimination claims. For employers, we advise on fair disciplinary procedures, retrenchments under section 189 of the Labour Relations Act, employment contracts and policies, and represent you at the CCMA and the Labour Court.

Knowing the Law – Staying Compliant in a Changing Landscape

National labour legislation prescribes how employers may — and may not — treat their employees. In addition, many industries are subject to sector-specific regulations and bargaining council agreements that impose further compliance obligations.

These laws govern every phase of the employment relationship, including:

  • recruitment and hiring,
  • training and performance management,
  • working conditions and remuneration,
  • discipline and grievance procedures, and
  • termination of employment.

For many employers, especially small to medium-sized businesses, keeping up with changing labour legislation can feel overwhelming. We work closely with employers and HR professionals to provide preventative advice, helping businesses understand their obligations and avoid costly disputes before they arise.

Preventative legal guidance remains one of the most effective tools for reducing labour risk and maintaining stable employment relationships.

Labour Law FAQs

How do I remove debt review in South Africa?

Debt review can only be removed once you have settled all qualifying debts and obtained a clearance certificate from your debt counsellor. Your credit profile is then updated with the credit bureaus to reflect that you are no longer under debt review.

How long does it take to remove debt review?

The timeframe depends on your individual circumstances. Once all debts are settled and the correct documentation is in place, the administrative process of updating your credit profile is usually relatively quick, but delays can occur if there are errors or outstanding obligations.

Can a lawyer remove me from debt review?

An attorney can assist by advising on your eligibility, ensuring the correct legal process is followed, and addressing complications or disputes. However, removal itself must comply with the requirements of the National Credit Act and typically involves your debt counsellor and credit bureaus.

Can debt review be removed early?

In limited circumstances, debt review may be exited earlier, but only if legal requirements are met. Attempting to exit prematurely without proper compliance may result in the process being rejected or reversed.

What is a clearance certificate?

A clearance certificate is a formal document issued by a registered debt counsellor confirming that all required debts have been settled and that you may be removed from debt review.

Will my credit record improve after debt review removal?

Yes. Once debt review is removed and your credit profile is updated, your ability to access credit may gradually improve, provided your financial conduct remains positive.

What happens if there are errors in my debt review status?

Errors can delay or prevent removal. In such cases, legal assistance may be required to resolve disputes with credit bureaus, debt counsellors, or credit providers.

Do I still need legal advice if I have a debt counsellor?

While debt counsellors manage the repayment process, an attorney can provide independent legal advice, particularly where there are complications, disputes, or uncertainty about your rights and obligations.

Can a labour lawyer represent me at the CCMA?

Not at every stage. Legal representation is generally not allowed at CCMA conciliation. At arbitration it depends on the type of dispute: in dismissals for misconduct or incapacity, a lawyer may appear only if the parties agree or the commissioner allows it. We can still advise and prepare you for every stage, and represent you at the Labour Court.

How long do I have to refer an unfair dismissal dispute?

30 days from the date of dismissal. A late referral needs an application for condonation, which may be refused, so do not wait.
